Scope first
Deliverables, pricing, revisions, timeline, and responsibilities are controlled by the approved proposal or written agreement.
Terms and Conditions
Clear terms for using this website, requesting services, approving proposals, payments, project responsibilities, revisions, ownership, and support.
Deliverables, pricing, revisions, timeline, and responsibilities are controlled by the approved proposal or written agreement.
Work, launch, final files, or transfer may pause until pending payments are cleared.
We work professionally, but SEO, marketing, sales, traffic, and business outcomes cannot be guaranteed.
These Terms and Conditions explain the rules for using our website, submitting an inquiry, requesting services, approving a proposal, making a payment, or working with TrendAux.
By using our website or services, you agree to these Terms. If you do not agree, you should not use the website or request services from us.
We provide digital services including web development, app development, AI automation, SEO, digital marketing, UI/UX design, and related strategy, design, development, optimization, and support work.
The exact services, deliverables, timeline, pricing, revisions, and responsibilities for a project will be stated in a written proposal, quotation, invoice, project brief, contract, or statement of work.
If a requested service, platform, or deliverable is not clearly included in the written scope, it is not included by default.
Work not clearly included in the approved proposal is outside the original scope and may require additional payment.
Additional work may include extra pages, new sections, new features, extra integrations, major redesigns after approval, rush delivery, rewriting content not included in scope, or ongoing support after project completion.
The client must provide accurate information, content, assets, access, feedback, and approvals needed to complete the project.
Client responsibilities may include business details, logo files, brand guidelines, images, text, product or service details, hosting access, CMS access, analytics access, platform access, payment gateway details, and timely approval of work.
We are not responsible for delays caused by late content, incomplete information, unavailable access, delayed feedback, payment delays, or third-party platform issues.
Pricing and payment schedules will be shared in a quotation, proposal, invoice, or written agreement. An advance payment may be required before work begins.
Final files, website launch, transfer of ownership, or further support may be withheld until all pending payments are cleared.
Payments for completed work, planning, research, design, development, setup, reserved project time, or third-party costs may be non-refundable unless otherwise agreed in writing.
If payment is delayed, we may pause work until payment is received. Project timelines may change if work is paused because of non-payment.
We may refuse to provide final files, publish work, transfer access, or provide further support until pending payments are cleared.
Refunds depend on the project stage and the amount of work already completed. Advance payments may be used to reserve project time and begin planning, research, design, or development.
Payments for completed milestones are non-refundable. If a client cancels after work has started, the client must pay for work completed up to that point.
Third-party purchases, subscriptions, licenses, domains, hosting, tools, and paid assets are not refundable through us.
If we are unable to complete a project due to our own fault, we may offer a partial refund based on the incomplete portion of the work.
The number of revisions included in a project will be stated in the proposal or project agreement. A revision means a reasonable change to agreed work, not a new design direction, new feature, or new scope.
Timelines are estimates and may change due to late feedback, missing content, new requirements, technical issues, third-party issues, or force majeure events.
A project may be considered complete when the agreed deliverables have been developed and shared for review, even if the client delays feedback, launch, or final approval.
Before launch, the client should review pages, links, forms, content, pricing, policies, integrations, tracking, and product or service details.
After approval and launch, new changes may be treated as additional work unless they are covered by a support or maintenance plan.
If the client delays final approval, content, access, or launch after deliverables are ready, the project may still be considered completed for billing and scheduling purposes.
The client is responsible for ensuring that all provided content, images, logos, trademarks, documents, and materials are legal, accurate, and properly licensed.
Our work may involve third-party platforms such as hosting, domains, CMS tools, analytics, email tools, payment gateways, APIs, automation tools, advertising platforms, or AI tools. We do not control third-party platforms and are not responsible for their downtime, policy changes, pricing changes, security incidents, or service limits.
If we use stock assets, fonts, icons, plugins, themes, apps, or third-party code, those assets may be subject to separate licenses and restrictions.
We may provide SEO, marketing, advertising, analytics, or growth-related services, but we do not guarantee specific rankings, traffic, sales, leads, followers, engagement, conversions, revenue, or business growth.
Results depend on competition, market conditions, budget, content quality, offer, audience, platform rules, and many other factors outside our control.
We may use AI-assisted tools for research, drafting, brainstorming, automation, content improvement, coding assistance, quality checks, or workflow optimization.
AI-assisted outputs may be reviewed and edited by our team, but the client remains responsible for final approval of published content, legal claims, factual claims, product information, pricing, and business representations.
We do not intentionally submit client confidential information into public AI tools unless necessary for the project or approved by the client.
Unless otherwise agreed in writing, the client owns final approved deliverables created specifically for the client after full payment is received.
The client retains ownership of their own logos, brand assets, content, product images, and business materials.
TrendAux retains ownership of reusable methods, internal processes, templates, frameworks, code snippets, automation logic, strategies, design systems, research methods, and pre-existing materials.
We may reuse general knowledge, skills, ideas, workflows, and non-confidential techniques learned during a project.
Until full payment is received, all work produced by us remains our property.
Unless the client requests confidentiality in writing, we may display completed work, screenshots, project summaries, client names, logos, or case study details in our portfolio, website, social media, proposals, or marketing material.
Both parties should keep confidential information private. If the client provides account access, the client should change passwords or revoke access after the project ends if continued access is not desired.
We are not responsible for security issues caused by weak passwords, shared credentials, outdated plugins, insecure hosting, client-side changes, or third-party breaches.
Unless a maintenance or support plan is purchased or clearly included in the proposal, ongoing support is not included after project completion.
Maintenance may include updates, backups, minor fixes, security monitoring, content changes, performance checks, or platform review depending on the selected plan.
Emergency support, malware removal, major fixes, redesigns, new features, or issues caused by third-party changes may require additional payment.
You must not use our website or services for illegal, harmful, abusive, fraudulent, misleading, or unethical purposes.
You must not use our services to create or promote illegal products or services, fraudulent schemes, malware, phishing, hacking, abusive content, misleading claims, copyright-infringing content, unauthorized data collection, or activity that violates applicable law or platform rules.
We may refuse or stop work that we believe is illegal, unethical, harmful, abusive, risky, or likely to violate applicable law, platform rules, or third-party rights.
Information on our website is provided for general business and informational purposes. We try to keep it accurate, but we do not guarantee that all website information is always complete, current, or error-free.
We may update, remove, or change website content at any time.
We may suspend or terminate services if payment is not made, required access or content is not provided, the client becomes abusive or uncooperative, the project involves illegal or unethical activity, scope repeatedly changes without agreement, or continuing work creates legal, financial, or reputational risk.
The client remains responsible for paying for all work completed before termination.
We are not responsible for delay or failure to perform caused by events outside our reasonable control, including internet outages, power failures, cyberattacks, natural disasters, war, strikes, government restrictions, platform outages, illness, or other unexpected events.
To the maximum extent permitted by law, TrendAux will not be liable for indirect, incidental, special, consequential, or business losses, including loss of profit, revenue, data, customers, reputation, or business interruption.
Our total liability for any claim related to a project or service will not exceed the amount paid by the client to us for that specific project or service.
You agree to protect and hold TrendAux harmless from claims, losses, damages, liabilities, costs, or expenses arising from misuse of our services, breach of these Terms, your provided content, violation of law, violation of third-party rights, or claims made by your customers or users related to your business.
